PECA Amendments Proposal: Three-Year Jail Term and Fines for Disinformation

The Pakistani government is proposing amendments to the Prevention of Electronic Crimes Act (PECA) to combat fake news and unlawful online content. The draft legislation, known as the Electronic Crimes Prevention (Amendment) Act 2025, introduces severe penalties, including up to three years in prison and fines of Rs2 million for individuals spreading disinformation.

A significant aspect of the amendments is the creation of the Digital Rights Protection Authority (DRPA), tasked with regulating social media and online platforms. This authority will have the power to block or remove unlawful content and enforce compliance with regulatory guidelines.

Key features of the amendments include:

  • Expanded Definitions: Social media platforms are now broadly defined to cover websites, apps, and any individuals or entities operating these platforms in Pakistan.
  • Authority Formation: The DRPA will comprise a chairperson and six members, including officials from the IT ministry, information ministry, and the Pakistan Telecommunication Authority (PTA). It will have the power to investigate complaints, direct content removal, and recommend actions to maintain digital ethics.
  • Content Regulation: The authority will monitor content related to blasphemy, hate speech, incitement to violence, defamation, and threats to national security. A list of 16 prohibited content categories has been outlined in the amendments.
  • Compliance Requirements: Social media platforms might be required to register with the government, open local offices, and assign representatives within Pakistan. Platforms will also face penalties if they fail to remove flagged content within the given time.

While the government argues that these changes are vital to address the growing issue of disinformation and online hate speech, critics express concerns over potential censorship and misuse of the law by authorities. The government has assured that the amendments will be implemented with transparency, with protections in place to safeguard citizens’ rights.

The draft amendments are expected to be presented in Parliament soon, marking a significant step in Pakistan’s effort to regulate its digital space.
