PHC to Review Petition Against ECP’s Notice to K-P CM

The Peshawar High Court has scheduled a hearing for a petition that challenges the Election Commission’s decision to issue a new notice to Khyber Pakhtunkhwa (K-P) Chief Minister Ali Amin Gandapur regarding the disclosure of his assets.

According to Express News, the court has published a formal cause list for the case. A two-member bench, consisting of Justice SM Atiq Shah and Justice Fahim Wali, will review the petition.

In the petition, Gandapur has named the Chief Election Commissioner, the Provincial Election Commissioner, and the Regional Election Commissioner as respondents. He contends that the Election Commission had initially issued a notice about his assets in April of the previous year, which was suspended by the Peshawar High Court, halting any further action from the commission.

Gandapur also stated that the Election Commission issued another notice concerning his assets on November 20, 2024, and resumed proceedings against him. He added that before the election, he had submitted the details of his assets in his declaration forms to the relevant Returning Officer and other authorities, and he was declared eligible to run for election from PK-113.

Furthermore, it was noted that following his election victory, the Election Commission issued an official notification confirming his win. The petition argued that after the establishment of election tribunals and the issuance of the gazette notification, the Election Commission no longer had the authority to make decisions on election-related matters.

The petitioners have requested the court to quash the Election Commission’s notice, claiming that it is an attempt to harass the petitioner and exert undue pressure.
